Otto Car - Terms & Conditions

1. Introduction

These Customer Terms set out the basis on which Otto Car Limited ("Otto Car", "we", "us", "our") provides vehicle rental and Rent to Buy services.

We are a company registered in England and Wales (Company No. 08479726) with our registered office at 3 Sussex Place, Hammersmith, London, England, W6 9EA. Our VAT number is GB 459599909.

These terms apply to all plans, packages, and services advertised on our website (www.ottocar.co.uk). Full contractual terms will be provided and agreed with you at the point you enter into a formal agreement with us.

By enquiring about or ordering a vehicle, you confirm that you have the legal capacity to enter into a contract.

2. Our services

We offer vehicle rental and Rent to Buy plans ("plans"). Each plan may differ in:

contract length
included services (e.g. insurance, breakdown cover)
pricing structure

Details of each plan are provided on our website and may be updated from time to time.

3. Pricing

Weekly prices are displayed on our website.
Prices may change at any time for new customers.
Once you have entered into a contract, your agreed price will not change unless your contract is amended.

4. Payments

Payments are taken weekly.

We accept Visa and Mastercard debit and credit cards.
You must ensure sufficient funds are available for each payment.
Failure to make payment may result in additional fees or suspension/termination of your agreement.

5. Fees and charges

You are responsible for all charges incurred during your use of the vehicle, including but not limited to:

penalty charge notices (PCNs)
congestion charges and tolls
mileage charges, where applicable

We may also charge administrative fees in certain situations, including:

processing fines or transferring liability
missed or late payments
excess mileage

Full details of applicable fees will be provided in your contract.

6. Use of the vehicle

You agree to:

use the vehicle primarily for private hire vehicle (PHV) purposes
comply with all laws and regulations
pay all fines, penalties, and related costs
adhere to any mileage limits specified in your agreement

Failure to comply with these obligations may result in additional charges or termination of your contract.

7. Cancellation

Before vehicle collection

Any applicable refunds (including deposits and down payments) will depend on the type of plan selected and timing of cancellation. These will be confirmed in your agreement.

After vehicle collection

Once you have collected the vehicle, your contract has started.

PCO Car Hire (rental) agreements: typically cancellable after a minimum period, subject to notice.
Rent to Buy agreements: typically cancellable after a minimum period, subject to notice.

Specific cancellation terms, including notice periods and any applicable charges, will be set out in your agreement.

8. Holiday allowances

If you have a Rent to Buy vehicle with Otto Car, you may be eligible to take up to 8 weeks of holiday payment breaks during each 12-month period, subject to approval and the terms of your Agreement.

To qualify for a holiday payment break, your account must be up to date and not in arrears at the time of your request.

Holiday payment breaks may only be taken in whole-week increments. The maximum duration of any single holiday payment break request is 4 consecutive weeks.

An administration fee of £25 per week applies for each approved holiday payment break.

Any approved holiday payment break will extend the term of your Agreement by the same number of weeks as the holiday payment break taken.

Holiday payment breaks are not guaranteed and are subject to review, approval, and the specific terms set out in your Agreement. Please refer to your Agreement for full eligibility criteria and conditions.

9. Deposits and refunds

Deposits may be required for rental plans.
Refunds (where applicable) are subject to deductions for:
- outstanding fees
- damage to the vehicle
- unpaid charges

Refund timelines will be confirmed in your agreement.

10. Insurance

Where insurance is included as part of your plan, details of cover, exclusions, and excess amounts will be provided in your contract.

Insurance arrangements may be subject to change or withdrawal.

11. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

We are not responsible for:

indirect or consequential losses
loss of income, business, or profits arising from use of the vehicle

Your responsibilities and liabilities in relation to the vehicle will be set out in full in your contract.

12. Changes to these Terms

We may update these terms from time to time. The latest version will always be available on our website.

Any changes will not affect existing contracts unless agreed with you.

13. Governing law

These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Warranty & indemnity

You acknowledge that the goods are required for the purpose of the business carried out by yourself and was selected by you on your own skill and judgement. You understand that you do not have the benefit or remedy under the consumer credit Act 1974. You have waived your right. You indemnify us against all claims, loss and damages arising from breach of the contract.

Under a Rent to Buy contract, we are a financial beneficiary for the period of the agreement and you will continue to pay for the rental even if the Vehicle fails to operate for any reason. You will not attempt to sell or re-hire the vehicle and shall promptly inform us of any personal email, telephone and address change by email at info@ottocar.co.uk or via the Driver Portal.
